All services are delivered based on a mutually agreed project scope, timeline, and pricing.
3. Payments
- A 50% advance payment is required before the commencement of any project.
- Work will not begin until the initial deposit is received.
- The remaining 50% must be paid before final project delivery, website transfer, or release of website credentials/files.
- All payments must be made via Payoneer unless otherwise agreed in writing.
- The advance payment is non-refundable once the project work has commenced.
- Failure to complete the final payment may result in suspension of the project or withholding of final deliverables.
4. Client Responsibilities
Clients agree to:
- Provide accurate and complete project requirements
- Provide necessary content, images, and access credentials on time
- Review deliverables and provide feedback promptly
Delays caused by the client may affect project timelines.
5. Intellectual Property
- Upon full payment, ownership of the final approved website design and development work will be transferred to the client.
- Apex Shopify Agency reserves the right to showcase completed projects in its portfolio unless otherwise agreed in writing.
6. Limitation of Liability
Apex Shopify Agency shall not be liable for:
- Business losses
- Loss of revenue or profits
- Indirect or consequential damages
- Issues caused by third-party services
Our total liability shall not exceed the total amount paid for the specific service.
7. Third-Party Services
Our services may involve third-party platforms such as:
- Shopify
- Hosting providers
- Payment gateways
- Apps and plugins
We are not responsible for downtime, policy changes, pricing updates, or technical issues caused by third-party providers.
8. Termination
We reserve the right to suspend or terminate services if:
- These Terms are violated
- Payment obligations are not fulfilled
- Abusive or inappropriate behavior occurs
Clients may also terminate a project subject to the Refund Policy.
9. Changes to Terms
We may update these Terms & Conditions at any time. Updated versions will be posted on this page with a revised date.
10. Governing Law
These Terms & Conditions shall be governed in accordance with the laws of Pakistan.
